EEO Services - Complaint Filing

As part of GSA’s service offerings, the Office of Civil Rights (OCR) provides Equal Employment Opportunity (EEO) services to federal employees who work for Commissions and Boards (CABs). OCR processes discrimination complaints for employees who feel they have been discriminated against in the workplace.  For both the employer and employee, and if the need arises, it is important to know the process and key time limits associated with pursuing a discrimination complaint.

Employees can initiate a complaint if he or she believes they have been discriminated against based on the following: race, color, religion, sex (including pregnancy, sexual orientation involving transgender status/gender identity, sex-stereotyping, and sexual harassment), national origin, age (40 years or older), disability (physical and mental), genetic information or retaliation (for prior participation in an Equal Employment Opportunity (EEO) activity or having opposed discrimination).  The employee has  45 calendar days from the day the incident occurred to initiate an informal complaint through the Equal Employment Opportunity EEO process.

GSA or the Equal Employment Opportunity Commission (EEOC) will extend the 45-day time limit only if the following applies: (1) when the individual shows that he or she was not notified of the time limits and was not otherwise aware of them, (2) that he or she did not know and reasonably should not have known that the discriminatory matter or personnel action occurred, (3) that despite due diligence he or she was prevented by circumstances beyond his or her control from contacting the counselor within the time limits, or (4) for other reasons considered sufficient by GSA or EEOC.

In addition, if the incident involved a personnel action (for example, a demotion or firing), the employee has 45 calendar days from the day the personnel action takes effect to initiate an informal complaint through the Equal Employment Opportunity EEO process.  If you have questions about initiating a discrimination complaint, feel free to contact OCR at:
