    An interim rule was published in the Federal Register on March 16, 2011 increasing competition requirement for Multiple Award Contracts, and implemented Section 863 of the Fiscal Year 2009 Duncan Hunter National Defense Authorization Act (NDAA).     As many of you are probably aware, on February 10, 2012 the Small Business Administration (SBA) issued a Final Rule increasing 37 small business size standards for 34 industries and three sub-industries in North American Industry Classification System (NAICS) Sector 54 Professional, Technical, and Scientific Services.

    The "other than small" MAS contractor cannot, and does not, rerep in response to the solicitation refresh. They can only rerep under one of the 3 conditions listed in the article.

    eBuy, GSA’s request-for-quote (RFQ) system, has been updated to facilitate set-asides. Now you can choose whether your requirement will be set-aside for small business or another small business category.  If you decide to set-aside the requirement, then the RFQ will be viewable only by eligible Schedule contractors. For example, only HubZone Schedule contractors could view a RFQ set-aside for HubZone small business concerns.

    All economic price adjustments (EPAs) in Schedule contracts are made in accordance with clause I-FSS-969 or clause 52.216-70, depending on whether the contract pricing is based on a commercial list price or not. Take a look at your Schedule contract to determine which clause applies to your contract. Once you determine which clause applies, read the clause to see what is expected under that clause (i.e. basis, frequency, and timing of EPAs). That should give you a good idea as to what is allowed and what the CO is looking for in terms of processing the EPA.
