    An interim rule was published in the Federal Register on March 16, 2011 increasing competition requirement for Multiple Award Contracts, and implemented Section 863 of the Fiscal Year 2009 Duncan Hunter National Defense Authorization Act (NDAA). The interim rule enhances competition requirements for orders placed against Multiple Award Contracts, including:

    Don’t do business with Companies that Have an Unpaid Delinquent Tax Liability or a Felony Conviction.   Seems like common sense, right?  However, this information may not be immediately known to a contracting officer.  In accordance with Public Law 112-74 and Public Law 112-55, concerning appropriated funds for FY2012, contracting officers at some agencies may not make an award to companies that have an unpaid tax liability or felony

In this first video, she covers the changes made in the Federal Acquisition Regulation (FAR): Part 19 and FAR Subpart 8.4. Some of the changes include new language of multiple organizational contracts, federal registration notices and attributes of the multiple award contracts.     GSA released a new toolbox on the Vendor Support Center to help offerors prepare to get on schedule and prepare better quality offers. The mandatory Readiness Assessment will help an offeror decide If they are ready to become a MAS Schedule contractor.

    Section 1331 of the Small Business Jobs Act of 2010 authorized discretionary use of set-asides against multiple award contracts (i.e. Multiple Award Schedules).  This includes setting-aside orders to 8(a) contractors. The provision did not authorize the use of sole-sourcing under the various small business programs.
