GSA FAS temporarily allows the award of non-TAA compliant products under MAS program to respond to the COVID-19 pandemic for limited Federal Supply Classes (FSCs)

 

The United States is under attack from COVID-19 and actions are being taken to protect all Americans. President Trump declared a National Emergency Concerning the COVID-19 Outbreak on March 13, 2020.  The health and safety of the American people is the U.S. government’s top priority. 

Due to the COVID-19 pandemic, demand for certain critical and essential supply items has increased to the point that many MAS contractors are unable to meet Federal demands with TAA compliant products. To address this, the GSA Senior Procurement Executive (SPE) has issued a Class Determination and Findings (D&F) citing non-availability as the basis for temporarily allowing the procurement of non-TAA compliant products under FSS MAS contracts for certain Federal Supply Classes (FSCs). FSCs are Product Service Codes (PSCs) that define a category of products or services that the government purchases.

This exception is limited to the FSCs found in Attachment 1 of SPE Memo 2020-11, which are subject to change.

MAS contractors that have access to products under these FSCs and can meet this urgent need, should submit a stand alone modification request via the eMod system when proposing to add non-TAA compliant products to an FSS contract.  Specific instructions on how to submit the modification can be found attached. Additional information and required templates can also be found on the GSA.gov MAS Contractor and Modification Requirements Page: www.gsa.gov/mascontractrequirements.

FAS will be notifying contractors that the D&F may apply to by issuing emails to the authorized negotiators that are listed on file. If you do not receive an email or your authorized negotiator is not up to date, please contact your Procurement Contracting Officer (PCO). You can find your PCO on gsaelibrary.gsa.gov by searching your contract number or company name.
