JoinCOVID-19 non-TAA exception authority expires April 30.
In response to the COVID-19 pandemic, GSA temporarily allowed the award of certain products that were non-compliant with the Trade Agreements Act (TAA) on MAS contracts under certain Federal Supply Classes (FSCs) with the issuance of SPE Memo SPE-2020-11. When the exception authority was issued in the Spring of 2020, the demand for certain critical and essential supply items had increased to the point that many MAS contractors were unable to meet Federal demands with TAA compliant products.
During the last year, the supply of TAA and American made products has increased to the point that these limited exceptions are no longer needed. GSA issued a Request for Information (RFI) on March 25 to better understand the health of the external supply chain regarding the availability of COVID related supplies from TAA compliant sources. The RFI closed on April 7th. The results of the RFI indicated there is no longer a need for a TAA waiver to expand the supplies available through the MAS program. GSA is focusing on sourcing American made supplies consistent with Executive Order 14005, “Ensuring the Future Is Made in All of America by All of America’s Workers.”
GSA determined that this temporary waiver is no longer needed to support the COVID-19 relief effort and has decided to allow the authority to expire on April 30th.
Effective May 1, 2021, GSA will issue a unilateral contract modification, to remove the non-TAA compliant products that were temporarily awarded from MAS contracts and ensure the products are removed from GSA Advantage.
