      Summary:  The Court of Federal Claims (COFC) has ruled in K-LAK Corporation v. The United States (COFC 09-771C, March 09, 2011) that the Air Force acted appropriately when it chose not to exercise an option on a procurement which was an 8(a) set aside and then awarded it under the FABS Schedule instead.

    Yes,  When questioned, most agencies indicate this is due to legislation associated with mandatory reduction in size of government.

    Yes. This is possible but only if the Ordering Officer has the Schedule contractor recertify its business size at the task order level.  This would most likely (but not exclusively) occur where the NAICS Code used by the GSA Schedule CO is different than the NAICS Code representing the preponderance of the work on a particular task order.

Where solicitation established multiple "tiers" with regard to potential shipping volume that could occur, and the record establishes that the agency considered the offerors' proposed prices under each tier, the agency properly focused its price evaluation on offerors' pricing applicable to the shipping volume the agency expected to experience.

    I'm interested to learn YOUR definition of green acquisition. To put the conversation into context, I work for a small, professional services firm that provides CMa (Construction Manager as agent) services for GSA. We don't design or build anything, but we're GSA's eyes and ears on a construction site. We ensure that buildings are built the way GSA expects, and mitigating risk to the Government.
