Based upon the feedback received at yesterday's ICE event, the change to the BPA clause #32 is hereby RESCINDED. Unqualified labor is under further review.

All,

Contractors are expected to provide qualified labor based on the labor description within the TORFQ. In an effort to ensure that we are getting the right personnel in the right positions, Term and Condition (32) from the BPA will be updated on the next round of mass modifications and is effective immediately. This language has been vetted/approved through GSA and our legal office.

START:

(32) QUALIFICATION AND TRAINING OF CONTRACTOR EMPLOYEES

The Contractor shall provide only fully trained, experienced, and technically proficient personnel. To be considered fully qualified, a contractor employee must possess the minimum acceptable educational degrees and certifications as required in the TORFQ for the position to be filled. When justified, relevant experience may be substituted for the minimal education standard, however, this substitution must be approved in advance of the start of performance, and approved in writing, by the contracting officer.

Additional educational standards may be satisfied by qualified and comprehensive experience in a specific position/subject. That is, if a job function (e.g. Engineer, Scientist, etc.) requires a minimum educational standard of a Bachelor Degree (BA/BS), additional designations (e.g. Sr., III, etc.) can be satisfied by a commensurate level of experience.

The Contractor shall not bill for labor hours or travel costs associated with Contractor employee training or education unless specifically required and authorized in a task order. However, with appropriate Government approval Contractor employees may be allowed to attend Government sponsored training at the Contractor's expense.
