IMPORTANT UPDATE: GSA Publishes GSAR Proposed Rule for Commercial Supplier Agreements (CSAs) on Federal Register

Today, the General Services Administration (GSA) published a proposed rule to amend the General Services Administration Acquisition Regulation (GSAR) to address 15 common Commercial Supplier Agreement terms that are inconsistent with, or create ambiguity with, Federal Law. The proposed rule addresses these common unenforceable terms within the Commercial Items Clause FAR 52.212-4 and clarifies the prevailing terms in the order of precedence.

This approach will decrease the time needed for legal review prior to contract formation, will significantly reduce costs to both the government and contractors, and will further clarify expectations for all parties.  This proposed rule is an important step to improve the acquisition process, and ensure that GSA's contracting vehicles remain the best-value solution for both government buyers and suppliers.
